This Privacy Notice (“Notice”) describes how we collect, use, process and disclose your Information in connection with our websites (“Sites”), casting for participation in Banijay Americas programs and any other services or activities where this Notice may be posted or made available by or on behalf of us (collectively, the “Services”). Our general Sites do not store personal information submitted directly through the Sites, except for limited technical information, security information, routing information, and consent-preference information necessary to operate, secure, maintain, provide, and manage the Sites. Personal information relating to casting, program participation, employment applications, releases, medical authorizations, background checks, compensation, or similar processes is collected through separate processes and applicable notices, releases, authorizations, or agreements. We use necessary cookies for basic website functionality and consent management. Non-essential cookies and similar technologies do not fire before consent. In the course of your use of our Services, we may use different technologies and ask you to provide us with certain Information to help us provide and improve our Services, to contact or identify you, to enable you to access certain parts of our Services, or as otherwise indicated in this Notice.  Our general Sites do not store personal information submitted directly through the Sites, but may process limited technical information as necessary to operate, secure, route, maintain, and provide the Sites and to manage cookie consent preferences.

We may collect the following Information about you in the following ways:

  • Information You Provide to Us

When interacting with our Services, you may provide Information to us. However, our general Sites do not store personal information submitted directly through the Sites. Information you provide to us is generally collected through non-website communications or separate casting, participant, employment, release, authorization, background-check, compensation, or other program-related processes. This may include:

  • When you communicate with us through the Services, via email, or through our customer support, we may receive certain Information, such as your name, email address, phone number, or other information you provide or is included in such communications.
  • When you register or submit an application to participate in an Banijay Americas program through a separate casting, participant, or program-related process, and not through our general Sites, we may collect certain Information, such as your name, contact information (e.g., email address, physical address, phone number), date of birth, gender, race, ethnicity, professional or employment-related information (e.g., job title, job history), social media handles or usernames, and any photograph or video you submit as part of that process.
  • If you apply for employment with us, your application may be submitted through a third-party applicant platform, such as Workday, and handled in accordance with the applicable applicant privacy notice or disclosures provided in connection with that application process. We do not collect or store employment application information through our general Sites.
  • If you participate in an Banijay Americas program, prior to your participation, we will collect certain Information from you to complete a background check, compensate you for your participation, and comply with our tax reporting obligations, such as your Social Security Number, passport number, driver’s license number, and bank account information.
  • If you participate in an Banijay Americas program, we will also collect photos, videos and voice recordings of you for public display and broadcast and for promotional and advertising purposes.
  • Automatically Collected Information
  • When interacting with our Sites, we may process limited technical information that is automatically transmitted by your browser or device solely as necessary to operate, route, maintain, secure, and provide the Sites and to manage cookie consent preferences. For EU/EEA visitors, this may include limited processing necessary to identify EU/EEA traffic and prevent Google Analytics from loading. Subject to the foregoing, our general Sites do not store personal information submitted directly through the Sites or use EU/EEA website visitor information for Google Analytics, targeted advertising, remarketing, personalization, session replay, social pixels, profiling, or similar non-essential purposes.
  • Device information – this includes Information, such as your device ID, the browser you are using and its display settings, your operating system, device type, session start/stop time, time zone and network connection (e.g., Wi-Fi, cellular). To the extent processed through our general Sites, device information is limited to technical information necessary to operate, route, maintain, secure, and provide the Sites and manage consent preferences.
  • Internet or other electronic network activity information – our Services may collect or use your internet protocol (IP) address, unique identifiers and other information regarding your interaction with our Services, including whether you viewed any videos or content on our Sites. For EU/EEA visitors, we do not use this information for Google Analytics, advertising, remarketing, personalization, session replay, social pixels, profiling, targeted advertising, or similar non-essential purposes.
  • Geolocation Data – we do not collect or process precise geolocation data through our general Sites. We may process limited location information inferred from IP address solely to identify EU/EEA traffic and prevent Google Analytics from loading, and for security, routing, and website operation purposes.
  • Usage Data – to the extent processed through our general Sites, Usage Data is limited to information necessary to operate, maintain, secure, and provide the Sites. For EU/EEA visitors, we do not collect or use user-level Usage Data through Google Analytics, advertising, remarketing, personalization, session replay, social pixels, profiling tools, or other non-essential third-party tags.

We may use necessary cookies and similar technologies that are required for basic website functionality and consent-preference management. Subject to applicable law and user choices, we may also use functional, analytical, performance, and advertising cookies. Non-essential cookies and similar technologies do not fire before consent.   • Information from Third Parties

We may receive Information about you from our affiliates, subsidiaries and sister companies. We also may receive Information about you from our business partners, including third-party casting agencies and/or websites, if you direct these partners to send your Information to us or if these partners are collecting your Information on our behalf. Your interactions with websites and tools offered by companies that are not affiliated with us are covered by the privacy policies of those companies, not this Privacy Notice. We encourage you to read those privacy policies to learn more about how your information will be used by these third parties.

If you participate or apply to participate in an Banijay Americas program, we may receive Information about you outside of our general website, including through program specific documents, background checks, participant releases, media authorizations or similar related process,  in connection with a background check prior to your participation, including any criminal records and/or driving records information. For certain Banijay Americas programs, where authorized by you or otherwise permitted by applicable law, we also may receive information about your health from medical professionals to confirm that you meet the physical and psychological requirements and other safety or eligibility requirements, such as your medical history, weight, information that could indicate a medical condition, your general health and wellness, and mental health information. We also may receive Information about you from publicly available sources, where relevant to casting, eligibility, safety, production, or promotional considerations, such as any comments, content or details that you post on websites, social media platforms and other publicly available sources, including any information that accompanies those posts, such as your name, username, email address, your likes or preferences, or profile picture, subject to your privacy settings on these platforms and/or websites.

  1. How We Use Your Information

We may use your Information for the following purposes:

  • Provision of Services – for the provision of our Services, including management and administration of our Sites, provision of technical or other customer support to resolve technical issues, website security and consent-preference management, and provision of a customized experience where such functionality is available. Our general Sites do not store personal information submitted directly through the Sites.
  • Recruitment of Participants for Banijay Americas Programs – we use your Information to audition and/or cast potential hosts, guest hosts, and/or contestants for Banijay Americas programs, including to perform background checks and ensure you meet all eligibility requirements, including physical and psychological requirements, to participate. This Information is collected through separate casting, participant, release, authorization, background-check, or other program-related processes, and not through our general Sites. If you choose to participate in any of our programs, we also will use your Information to compensate you for your participation.
  • Manage career opportunities with us – If you apply for employment with us, your application may be submitted through our third-party applicant platform, such as Workday, and will be handled in accordance with the applicable applicant privacy notice or disclosures provided in connection with that application process.
  • Collaborate with Business Partners – we use your Information to collaborate with our business partners, such as our network and platform partners, who produce, broadcast, distribute and promote Banijay Americas programs.
  • Communications – we use your Information to communicate with you and respond to your inquiries or requests regarding our Services, or customer service inquiries, to request feedback or to keep you informed of our latest updates to our Services.
  • Marketing and advertising purposes – we may use your Information to send you promotional materials, such as marketing emails, concerning our Services, where permitted by applicable law and where you have provided contact information for that purpose. We do not use personal information collected through our general Sites for targeted advertising, and we do not sell or share personal information collected through our general Sites as those terms are defined under applicable U.S. state privacy laws. Non-essential cookies and similar technologies do not fire before consent. For EU/EEA visitors, we configure Google Analytics so that it does not load, set cookies, access browser/device storage, or transmit analytics data. If you participate in an Banijay Americas program, we may use Information about you, such as photos and/or videos of you and other participants, for promotional and marketing purposes, subject to applicable releases, authorizations, consents, or other program-related agreements.
  • Improvement of our Services– we may conduct surveys or test features, and analyze the Information we have to develop, maintain, measure and improve our Services. For EU/EEA visitors, we do not use Google Analytics on the Sites.
  • Operate our business: to support our internal business functions, including finance, accounting and audit.
  • With your consent – we may use your Information with your consent for other purposes described at the point of collection.
  • Protecting our interests – we may use your Information when we believe it is necessary in order to take precautions against liabilities, investigate and defend ourselves against any third-party claims or allegations, investigate and protect ourselves from fraud, protect the security or integrity of our Services and protect the rights and property of Banijay Americas, its users and/or partners. We also may use your Information in order to enforce our policies, Terms of Use, and any respective agreements we may have in place with you as a participant on an Banijay Americas show.
  • Maintenance of security and compliance with legal and regulatory requirements we may use your Information to detect and prevent fraud by verifying your identity, maintain the integrity and security of the Services, investigate violations, and as otherwise required by law, regulation or other governmental authority, or to comply with a subpoena or similar legal process.
  1. How and With Whom We Share Your Information

We may disclose Information collected through separate casting, participant, employment, release, authorization, background-check, compensation, or other program-related processes as described below. Our general Sites do not store personal information submitted directly through the Sites, and we do not sell or share personal information collected through our general Sites as those terms are defined under applicable U.S. state privacy laws.

  • Affiliates, Subsidiaries, and Sister Companies – we share your Information with our subsidiaries, affiliated companies, and sister companies where appropriate for the purposes described in this Notice.
  • Vendors and Service Providers – we share your Information with third-party vendors and service providers that perform services for us or on our behalf, such as website or system hosting, cloud hosting, data analytics, IT infrastructure services, payroll services, background check service providers, and email delivery services.  We require service providers to process Information only for appropriate business purposes and subject to applicable contractual restrictions.
  • Business Partners – we share your Information with our business partners, such as our network partners, to carry out the production, broadcasting, and advertising of Banijay Americas shows.
  • Advertising Partners – we do not sell or share personal information collected through our general Sites as those terms are defined under applicable U.S. state privacy laws. Subject to applicable law and user choices, the Sites may include non-essential advertising cookies or similar technologies, but such technologies do not fire before consent. For EU/EEA visitors, we configure Google Analytics so that it does not load, set cookies, access browser/device storage, or transmit analytics data.
  • Press and Media – we and our network partners may share your Information to press and media outlets to promote Banijay Americas programs.
  • Others – we may disclose your information with our professional advisors including lawyers, auditors and insurers, and other parties if you ask, authorize or direct us to do so.
  • Compliance with Laws and Enforcement Entities – we may disclose your Information (i) if we are required to so by law or legal process, such as a court order or subpoena; (ii) in response to requests by government agencies, such as law enforcement authorities; (iii) to establish, exercise or defend our legal rights (e.g., to enforce our Terms of Use); (iv) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; or (v) in connection with an investigation of suspected or actual illegal activity.
  • Mergers and Acquisitions – we may share your Information if we enter into a business transaction, such as a merger, divestiture, acquisition, restructuring, reorganization, dissolution, consolidation, bankruptcy, liquidation, or other sale or transfer of business transaction involving all or part of our company or assets or wind down of business, including for the purposes of determining whether to proceed with such transaction. Any party that acquires our assets as part of such transaction may continue to use your Information in accordance with the terms of this Notice.
  • Deidentified and Aggregated Information – we may aggregate and/or de-identify your Information such that it is no longer able to be linked to you or your device(s). This Notice does not limit our ability to use or disclose such aggregated or de-identified information, which we may disclose in our sole discretion.

Cookies and similar technologies are small files or tools that may be stored on or accessed from your browser or device. We use necessary cookies to operate the Sites and manage consent preferences. Necessary cookies are always active because they are required for basic Site functionality and do not store information used for targeted advertising or profiling. Where available, you may also use our cookie banner or preference tool to manage non-essential cookies. Blocking or disabling certain technologies may affect the functionality of the Sites.   • Targeted Advertising and “Sale” or “Sharing” of Information

Subject to applicable law and user choices, the Sites may include non-essential advertising cookies or similar technologies, but such technologies do not fire before consent. Where applicable, you may use the designated tools available on our Site, as more fully described in our U.S. State Supplement, to manage cookie preferences or opt out of targeted advertising, sale, or sharing.

Where required by applicable law, you may opt out of the sale, sharing, or use of personal information for targeted advertising by using the mechanisms made available on our Sites or by contacting us as described in this Notice.   • Individual Rights

  • delete certain personal information we have about you;
  • request correction of inaccurate personal information we have about you;

Once we receive your request, we may verify it by requesting information sufficient to confirm your identity. We reserve the right to deny requests as allowed by applicable law, such as where we have a reasonable belief that the request is fraudulent, where your identity cannot be confirmed, or where we must retain your Information consistent with applicable law. Our goal is to respond to a verifiable consumer request within 45 days (for U.S. residents), of its receipt. If we require more time, we will inform you of the reason and extension period in writing within the initial response period. We will deliver our written response, electronically. If reasonably possible, we will provide your Information in a format that is readily useable and should allow you to transmit the information without hindrance.

In case of rejection, the response we provide will explain the reasons for which we cannot comply with your request. We will not discriminate against you for exercising your rights and choices, although some of the functionality and features available on our Services may change or no longer be available to you.

Our general Sites do not store personal information submitted directly through the Sites. For EU/EEA visitors, we do not retain Google Analytics data from the general Sites where Google Analytics is configured not to load for EU/EEA traffic. We retain Information collected through separate casting, participant, employment, release, authorization, background-check, compensation, or other program-related processes for as long as necessary for the relevant purpose, including legal, contractual, accounting, compliance, dispute-resolution, and recordkeeping purposes.

Our Services may contain links to other websites or other online services (such as social media platforms), and may include third party features such as apps, tools, widgets and plugins. This U.S. State Supplement provides information for U.S. residents whose state privacy laws provide rights with respect to personal information. Our general Privacy Notice explains what Information we collect about you, how we collect that Information, and how we use and disclose that Information. Individuals who reside in states with applicable privacy rights should read this Supplement together with our Privacy Notice to understand our collection, use, disclosure, retention, sale, sharing, and other processing of Information. Any capitalized terms we do not define in this Supplement are defined in our Privacy Notice.

 

Your Rights

Your rights as specified under applicable state law may include the following:

  • Access your personal information or receive information regarding our processing of your personal information. For example, you may have the right to access a copy of personal information that we have collected about you or to ask us to confirm whether we process your personal information.
  • Correct inaccurate personal information. You may have the right to request that we correct any inaccuracies in the personal information we have collected about you.
  • Delete your personal information. Upon your request, we may delete certain personal information we have collected about you.

We may ask for additional information, such as your email address, phone number, or other information reasonably necessary to verify your identity. Requests to Opt-Out of Targeted Advertising and “Sale” or “Sharing” of Personal Information

Because we do not use personal information collected through our general Sites for targeted advertising and do not sell or share personal information collected through our general Sites, the opt-out mechanisms described in this section may not be applicable to current Site practices. Subject to applicable law and user choices, the Sites may include non-essential advertising cookies or similar technologies, but such technologies do not fire before consent. California

California residents should review the below California-specific disclosures provided in accordance with California law.

For purposes of this section, the “CCPA” shall mean Consumer Privacy Act, Cal. Civ. Code § 1798.100 et seq., as amended by the California Privacy Rights Act of 2020, and the regulations promulgated thereunder.

In the preceding 12 months, we have collected the following categories of personal information through separate casting, participant, employment, release, authorization, background-check, compensation, or other program-related processes, and we may process limited technical information through our general Sites as necessary to operate, secure, route, maintain, provide the Sites, and manage cookie consent preferences:

 

  • Personal identifiers, such as name, email address, physical address, phone number, and social media identifiers. To the extent IP address or similar network information is processed through the Sites, such processing is limited to technical operation, security, routing, consent management, and, for EU/EEA visitors, identifying traffic to prevent Google Analytics from loading.
  • Internet or other electronic network activity information, such as searches on our Services, information about your interactions with our Services, and any advertisements or videos viewed thereon. For EU/EEA visitors, we do not use this information for Google Analytics, advertising, remarketing, personalization, session replay, social pixels, profiling, targeted advertising, or similar non-essential purposes.
  • Additional Data Subject to Cal. Civ. Code § 1798.80, such as your government identification numbers (e.g., driver’s license number) and bank account information.
  • Protected Classifications under applicable U.S. state or federal law, such as race, gender, and ethnicity.
  • Professional or Employment- Related Information, such as payroll information, tax related information, job history, background check information, including criminal records or driving records information.
  • Sensory Information, such as electronic, visual and similar information.
  • Coarse (non-precise) geolocation information, if inferred from IP address, is used for limited technical purposes, including identifying EU/EEA traffic to prevent Google Analytics from loading. We do not collect or process precise geolocation information through our general Sites.
  • Inferences drawn from the information identified above, if any, only where relevant to casting, eligibility, safety, production, promotional, or similar program-related considerations. We do not use personal information collected through our general Sites to create profiles for targeted advertising or cross-context behavioral advertising.

Sensitive Personal Information

Certain categories of personal information listed above may be considered sensitive personal information as defined under California law.  We do not use or disclose “sensitive personal information” in any way that would require us to provide an opt-out opportunity under California law.

 

We collect the categories of personal information above from you and from the following categories of partners and services:

  • our affiliates, subsidiaries, and sister sites;
  • our service providers and vendors performing services for us or on our behalf;
  • our business partners, such as our third-party casting partners, agencies and/or websites;
  • our advertising networks, only if applicable and only to the extent not related to personal information collected through our general Sites;
  • our social networks;
  • our data analytics providers, only if applicable and only to the extent not related to EU/EEA Google Analytics data or targeted advertising through our general Sites; and
  • data brokers, such as background check services.
  • In the preceding 12 months, we have disclosed the categories of personal information above to service providers, vendors, affiliates, subsidiaries, sister companies, business partners, professional advisors, government authorities, and other recipients where permitted or required by law and for the purposes described in this Notice. We do not sell or share personal information collected through our general Sites as those terms are defined under applicable U.S. state privacy laws.

Children under 16

We do not “share” or “sell” (as defined under California law) personal information of children we know are under 16 years of age.
